Charlotte Update

Here’s what’s happening right now in Charlotte: • The Union is still in the process of AWS negotiations for an updated MOU. • Multiple grievances are currently on hold due to the ongoing funding lapse. • Despite this hurdle, the Union has been able to work with local management to address many concerns and get them resolved. • The Union also hopes to speak with local management soon about an update on the Etihad flight that is being processed regularly before our operating hours. We’ve heard from many of you that you’re being told we will be processing this flight until August.

Raleigh Update

Here’s what’s happening right now in Raleigh: • Union Stewards Legette and Milian are working with management on how anticipated overtime is assigned and when ad hoc overtime can be approved. • The Union is hoping to mirror Charlotte’s current practice, where anticipated overtime is assigned seven days out. For example, on Monday they assign the anticipated overtime for the following Monday. • At the same time, Charlotte reviews ad hoc overtime requests and approves them seven days before the start of the ad hoc. • We are asking to try this approach in Raleigh on a trial basis, just like Charlotte did. Charlotte’s trial in April of last year was such a success that they never went back to the old way.

CBP — Agreement on MFF Training

NTEU and CBP have reached an agreement concerning the impact and implementation of mandatory MFF training. The MOU is now subject to Agency Head Review before it can be implemented, which CBP has committed to expediting.

I am very pleased to announce that your NTEU bargaining team reached an agreement with CBP concerning Mobile Field Force training. It is no longer mandatory for all CBPOs — those hired on or before July 6, 2008, are not required to take the MFF training. Other exemptions include:

• CBPOs with a temporary medical waiver from Use of Force training are automatically excused from MFF training for the duration of their waiver.

• CBPOs with medical conditions that would prohibit them from chemical munition (CS gas) exposure (which is part of the MFF training) can request a medical waiver and will not be scheduled until the request is adjudicated.

• CBPOs will only be required to receive one (1) CS gas exposure, and those who have already had that exposure with CBP will not need to repeat that portion of the MFF training.

CBPOs will be given no less than three (3) weeks’ notice of MFF certification and recertification classes and will have at least five (5) days to volunteer. Selections for sessions will be seniority-based, with volunteers in seniority order followed by drafts in inverse seniority. Additional information can be found in the attached MOU.

I want to thank NTEU Chapter Presidents Robert Odom (128), Robert Briseno (160), and Matthew Smith (173) for their hard work and perseverance in bargaining this MOU alongside NTEU staff.

It is very important to note that the MOU is now subject to Agency Head Review (AHR) pursuant to 5 U.S.C. § 7114(c) before it goes into effect. As part of the remedy for CBP implementing MFF training before fulfilling its bargaining obligations, CBP has committed to conducting an expedited AHR, and we expect to have an implementation date very soon. I will notify you when we have more information.

NTEU e-Bulletin

The President on Friday directed the Department of Homeland Security to pay all of its employees amid a partial shutdown that has lasted over 50 days. 

​

The presidential memorandum authorizes paychecks for employees who have gone without pay since DHS funding stopped on Feb. 14. However, it is unclear where the administration would draw funds from for the payments.

​

Both chambers remain in recess until April 13. Lawmakers left Washington without making any real progress on a funding deal. The Senate passed a bill to fund most of DHS for the remainder of the fiscal year, but House leadership refused to bring up a vote on the bill.
